The vulgar photomontage of a police office is not insulting


Lawyer Mathieu CROIZET defended a person prosecuted for public insult.The Paris Court of Appeal upheld the judgment of the TGI of October 20, 2016, which had considered that the dissemination on Twitter of a photomontage depicting the head of a police commissioner replaced by a phallus and on which appeared his name associated with his title, no matter how vulgar and offensive, did not exceed the accepted limits of freedom in matters of satirical expression. In its judgment of 15 June 2017, the court stated that "the indication of his official title as head of the DNLH [national division for combating hooliganism], filmed in uniform, clearly demonstrates that the cartoon is aimed exclusively at his function as a symbol of the implementation of a contested policy of preventing violence in stadiums ; that the author had not therefore sought to harm him or to attack him personally, even if his name had been distorted in the same crude manner; that whatever the taste, good or bad, of the publication in question, which it was not for the court to assess, it had not exceeded the permitted limits of freedom of expression in the area of caricature or satire. It concluded that the offence of insult had not been established and therefore dismissed the police commissioner's claims for damages.
